This is a template. It sets out terms consistent with how this site is built, but it has not been reviewed by a lawyer. Have Canadian counsel review and adapt it before you operate under it.
1. Acceptance
By using this website or submitting an application through it, you agree to these terms. If you do not agree, do not use the site. These terms are in addition to, and do not replace, the agreement governing any facility that is subsequently funded.
2. What this site is
Canada Capital Finance is not a lender. We do not make loans and we do not make credit decisions. We operate a network of private lenders and provide a matching service only: we take your application, approach funders on our panel for financing between $10,000 and $200,000, and pass their offers back to you. We are not acting as a representative, agent or correspondent for any lender, we do not endorse any particular lender or loan product, and we do not control and are not responsible for the actions or inactions of any lender. Every written offer names the party actually extending the credit. You are under no obligation to use our service or to apply for credit with any of the lenders we approach.
Nothing on this site is an offer of credit. Rates, payments, terms and timelines shown here — including any figure produced by the calculator on the home page — are illustrative estimates for general information. They are not personalised, not guaranteed, and not binding on us or on any funder. Only a written offer issued to you after review constitutes an offer, and only a signed agreement creates a facility.
3. Eligibility
To apply, you must:
- Be at least the age of majority in your province or territory.
- Be a resident of Canada with a Canadian bank account in your own name or your business's name.
- Have the legal authority to enter into the agreement, including, for a business application, authority to bind the business.
- Be applying on your own behalf or on behalf of a business you are authorised to represent.
4. Accuracy of information
You agree that the information you submit is true, accurate and complete, and that you will tell us promptly if it changes while an application is open. Applications containing materially false information will be declined, and knowingly providing false information to obtain credit may constitute an offence.
5. Contact consent
By ticking the consent box you agree that we may contact you by telephone, email and SMS about your application, including using automated dialling, at the numbers you provide. Message and data rates may apply. You may withdraw consent to marketing contact at any time; contact about an open application or an active facility will continue.
6. Credit checks
By submitting an application, you authorise participating lenders to verify your information and check your credit to assess your application, including against national databases such as Equifax, TransUnion and Experian. Some credit checks may be recorded on your credit file. Ask your specialist which type of check a lender will use before you agree to proceed with that lender.
7. Fees
We do not charge you a fee to apply, to receive a quote, or to have your application placed. We are compensated by the funder when a file completes. We will never ask you to send money in advance to release a loan. We also do not publish a telephone number, so an unsolicited call claiming to be us should be treated with suspicion. If someone claiming to represent us asks you for money, it is a fraud — write to contact@canadacapitalfinance.com and report it to the Canadian Anti-Fraud Centre at antifraudcentre-centreantifraude.ca.
8. Acceptable use
You agree not to:
- Submit an application in someone else's name without their authority.
- Submit automated, repeated or fraudulent applications.
- Attempt to gain unauthorised access to any part of this site, including the administrative dashboard.
- Scrape, mirror or reproduce the site's content for commercial purposes.
- Interfere with the operation of the site or the systems behind it.
9. Intellectual property
The content, design, text and code of this site are owned by Canada Capital Finance or its licensors. You may view and print pages for your own use in connection with an application. All other use requires written permission.
10. Third-party links
Where we link to another site, we do not control it and are not responsible for its content, its accuracy or its privacy practices. A link is not an endorsement.
11. Availability
We aim to keep this site available but do not guarantee uninterrupted access. We may suspend, withdraw or change any part of it without notice. If the site is unavailable, write to contact@canadacapitalfinance.com and we will take your application that way.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising from your use of this site, including lost profits or lost opportunity. Nothing in these terms limits liability that cannot be limited by law, including liability for fraud. Some jurisdictions do not allow certain limitations, in which case the limitations apply only to the extent permitted.
13. Complaints
Write to contact@canadacapitalfinance.com or to the Compliance Officer at the address below. We acknowledge complaints within two business days and respond substantively within fifteen. If you remain dissatisfied, you may escalate to the relevant provincial consumer protection authority.
14. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. The courts of Ontario have jurisdiction, without prejudice to any right you have to bring proceedings in your own province under applicable consumer protection legislation.
15. Changes
We may amend these terms by posting a revised version on this page with a new date. Continued use of the site after that constitutes acceptance. The terms in force when you submitted an application govern that application.
